Terms of Service
Last updated October 22, 2026
These terms are an agreement between you and the Spells and Shells team (“we”, “us”) about your use of Spells and Shells at spellsnshells.com (the “game”). By signing in or playing, you accept these terms and our Privacy Policy. If you do not accept them, do not use the game.
1. Adults only
You must be 18 or older to use the game. Every account confirms its age before entering. If you are under 18, do not use the game. We lock any account that tells us its player is under 18, and we may lock or remove any account we reasonably believe belongs to someone under 18.
2. Your account
You sign in with your Discord or Google account. You are responsible for everything done through your account and for keeping the accounts you sign in with secure. Your username is chosen once and cannot be changed. You must also follow Discord’s own terms when using Discord to sign in.
3. Fiction, game currency and items
The game is fiction. Its crimes, violence, syndicates, casino games, crypto market and economy are imaginary and are not a guide to real-world behaviour. All cash, crypto, items, rewards and winnings in the game are game currency and virtual items only. They have no real-world monetary value, cannot be cashed out, and are licensed to you for use in the game, not sold or owned. No real money is wagered or paid out in the game’s casino.
4. Donations and Membership Tokens
The game is free to play. Buying Membership Tokens is optional and supports the game.
- What you buy. Membership Tokens are virtual items, like everything else in the game (section 3). Using one adds 30 days of donator membership. The benefits of membership are listed on the Donator page and may change like any other part of the game (section 8).
- Payment. Payments are made through PayPal at the US dollar price shown when you buy, and PayPal’s own terms apply to the payment. We never see your card or bank details.
- Monthly subscription. You can instead subscribe for a monthly price shown on the Donator page. Each completed monthly payment delivers one Membership Token, the same as buying one. The subscription renews every month until you cancel it on the Donator page or in your PayPal account; cancelling stops future payments, and tokens already delivered stay yours. If a payment fails, PayPal may pause the subscription and no token is delivered for that month.
- No cash value. Tokens and membership cannot be exchanged back for real money. Inside the game, tokens can be traded, sold to the city or given away like other items; selling or buying them for real money outside the game is not allowed (section 5).
- Delivery. Tokens are delivered to your inventory as soon as PayPal confirms the payment. If you were charged and the tokens did not arrive, tell us with Support → Report a Bug and we will deliver them or refund you.
- Refunds. Because tokens are delivered straight away, all purchases are final and not refundable, except where the law requires a refund or as described under Delivery. Where the law gives you a right to cancel a purchase of digital content, you agree that delivery starts immediately and that you lose that right once the tokens are delivered.
- Refunds and chargebacks. If a payment is fully refunded (including a refund we give under Delivery) or reversed through PayPal or your bank, the Membership Tokens it paid for are taken back from your account: first any tokens still in your inventory, then 30 days of remaining membership for each token already used. Anything that cannot be taken back that way, for example tokens you traded or sold, stays owed, and you cannot buy tokens until staff clear it; a monthly subscription pays off what is owed before delivering new tokens. Tokens you passed on to other players stay with them. Partial refunds are reviewed by staff. While a payment is disputed we may suspend the account until it is resolved.
- Bans and closed accounts. If your account is banned or closed for breaking these terms, any unused tokens and remaining membership are lost and are not refunded.
5. Rules of conduct
When using the game, including chat, direct messages, mail, profiles, photos, syndicate pages and reports, you must not:
- harass, threaten, bully or stalk anyone, or post hateful content targeting people for who they are;
- post sexual content involving minors, sexually explicit images, or any illegal content;
- share anyone’s personal information without their permission;
- spam, advertise, scam other players or impersonate staff or other players;
- cheat, exploit bugs, tamper with the game’s requests or servers, or try to access accounts or data that are not yours;
- buy, sell or trade game currency, items (including Membership Tokens) or accounts for real money or anything outside the game, other than buying Membership Tokens from us through the Donator page.
If you find a bug that gives an unfair advantage, report it to the staff instead of using it.
6. Content you post
You keep ownership of what you write and upload. You give us a non-exclusive, worldwide, royalty-free licence to store, display and share it within the game as the game’s features intend (for example, showing your messages to the people you send them to and your profile to other players). You must have the right to post anything you upload. Players can report content and accounts; reported messages are saved, with a few earlier messages for context, so the staff can review them.
7. Moderation
We may remove content and warn, mute, temporarily ban, permanently ban, lock or reset accounts that break these terms or harm the game or its players. We try to be fair and explain decisions, but we decide at our discretion.
8. Changes to the game
The game is under active development. We may change, rebalance, reset, add or remove any feature, item, value or content at any time, and we may suspend or end the game. We do not owe compensation for such changes, including changes to membership benefits. If we end the game, we will announce it in advance and stop selling Membership Tokens first.
9. No warranty
The game is provided “as is” and “as available”, without warranties of any kind. We do not promise that it will be uninterrupted, error-free or that progress will never be lost.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, game progress or virtual items, arising from your use of the game. Our total liability for any claim relating to the game is limited to the amount you paid us for Membership Tokens in the 12 months before the claim (US $0 if you paid nothing).
11. Ending your use
You may stop playing at any time and ask us to delete your account (see the Privacy Policy). We may suspend or close accounts as described in section 7.
12. Governing law
These terms are governed by the laws of the United States and of the U.S. state in which the Spells and Shells team is based, without regard to conflict-of-law rules.
13. Changes to these terms
We may update these terms. The date at the top shows the latest version, and important changes will be announced in the game’s news. Continuing to play after a change means you accept the updated terms.
